Terms and Conditions

These terms are the agreement between you and us when you use Oithere, the Mac app, and this website. By creating an account or starting a trial, you accept them.

What Oithere is

Oithere is a focus coach for Mac. During a focus session it reads the window in front of you, compares it with the work you named, and nudges you when you drift.

Oithere needs a Mac with macOS 15 or later. It also needs the macOS permissions it asks for during setup. Without them it cannot see your screen and will not work.

Your account

  • You sign in with your email address and a code we send to it.
  • You must be at least 18, or old enough to enter a contract where you live.
  • An account is for one person. It works on up to three Macs that you use. Signing in on a fourth signs out the Mac that has been signed in longest.
  • Keep your email account secure. Anyone who can read your email can sign in to Oithere as you.

Free trial and subscription

  • Oithere is sold as a monthly or yearly subscription.
  • A new subscription starts with a 7-day free trial. You add a payment method at checkout and are not charged during the trial.
  • If you do not cancel before the trial ends, the first payment is taken when it ends.
  • The subscription then renews by itself, each month or each year, until you cancel.
  • The price is the one shown at checkout for your country, with tax included where it applies.

Payments are handled by Stripe

Our order process is conducted by our online reseller Link, a Stripe company. Link is the Merchant of Record for all our orders, and your purchase is sold through Link. Link handles questions about payments and returns.

That means you buy your subscription from Link, and the terms shown at checkout apply to the purchase alongside these terms. Stripe takes the payment and works out the tax, and Link sends your receipts and invoices. The charge appears on your statement as LINK.COM* followed by our name.

Cancelling

You can cancel at any time. In Oithere, open Settings and choose Manage subscription, or sign in at link.com with the email you paid with.

  • If you cancel during the free trial, you are not charged. Your access ends no later than the end of the trial.
  • If you cancel after you have paid, Oithere keeps working until the end of the period you paid for. No further payments are taken.

Your licence to use Oithere

While your trial or subscription is active, we give you a personal, non-exclusive, non-transferable licence to install and use Oithere on your own Macs. The app, its design, its text and its name belong to us.

You agree not to:

  • share your account, or resell or rent Oithere to anyone else;
  • get around the sign-in, the licence check or the Mac limit;
  • copy, modify, decompile or reverse engineer the app, except where the law gives you that right;
  • use Oithere to break the law or to harm our services.

What to expect from the coach

Oithere uses AI models to understand what is on your screen and to write what it says to you. They make mistakes. A nudge can be wrong, late or missing. Oithere is a tool for your own focus. It is not medical, psychological or professional advice, and it does not replace treatment for any condition.

Changes to Oithere

We keep improving Oithere, so features change, and some may be removed. We will not remove the core of what you pay for without telling you first. The service can be unavailable at times, for maintenance or for reasons outside our control.

Changes to prices and these terms

If we change the price of your subscription or make a change to these terms that matters to you, we will email you at least 30 days before it takes effect. A new price applies from your next renewal after that date. If you do not agree, you can cancel before the change takes effect.

Ending your access

We may suspend or end your access if you seriously or repeatedly break these terms, or if a payment fails and is not put right. If we end your access for another reason, we refund the part of the period you paid for and did not use.

Our responsibility to you

We provide Oithere with reasonable care and skill. Beyond that, and as far as the law allows:

  • Oithere is provided as it is, with no promise that it will be free of errors or always available;
  • we are not responsible for losses we could not reasonably have foreseen, or for lost profit, lost business or lost data;
  • our total responsibility to you is limited to the amount you paid for Oithere in the 12 months before the claim arose.

Nothing in these terms limits our responsibility for intent or gross negligence, for death or personal injury we cause, or for anything else the law does not let us limit. If you are a consumer, nothing here takes away rights the law gives you.

Law and disputes

These terms are governed by the law of the Republic of Lithuania, and disputes go to the courts of Vilnius. If you are a consumer living in another country, you keep the protection of the mandatory laws of that country, and you can bring a claim in the courts where you live.
